Legal terms governing the use of the KundPro platform.

Welcome to KundPro™, a software platform developed and operated by KundCo. By accessing or using the KundPro website, application, or services (the "Service"), you agree to be bound by these Terms of Use.

If you do not agree to these Terms, you may not use the Service.

1. Description of the Service

KundPro is a Customer Relationship Management (CRM) and Agency Management System (AMS) designed primarily for insurance agents and agencies, including those serving the Medicare and senior insurance markets.

The Service may include features such as:

  • Client management
  • Policy tracking
  • Commission tracking
  • Tasks and reminders
  • Reports and analytics
  • Document storage
  • Data export functionality

KundPro may modify or update the Service at any time.

2. Eligibility

You must be at least 18 years old to use the Service.

By using KundPro you represent that:

  • You have the authority to enter into this agreement.
  • You will use the Service only for lawful purposes.
  • You will comply with all applicable laws and regulations.

3. Account Registration

To access certain features, users may be required to create an account.

You agree to:

  • Provide accurate information during registration
  • Maintain the security of your login credentials
  • Accept responsibility for activity occurring under your account

You must notify KundPro immediately if you suspect unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Transmit malware or malicious code
  • Attempt to gain unauthorized access to the Service
  • Reverse engineer or exploit the software
  • Disrupt the operation of the platform

KundPro reserves the right to suspend or terminate accounts that violate these Terms.

5. Insurance Compliance Responsibility

KundPro provides software tools only.

Users are solely responsible for ensuring their use of the platform complies with all applicable laws and industry regulations, including but not limited to:

  • CMS Medicare marketing regulations
  • Insurance licensing laws
  • Privacy and consumer protection laws

KundPro does not provide legal or regulatory advice.

6. Data Ownership

Your Data Belongs to You.

Users retain ownership of all client information, policy information, documents, and other materials uploaded to the Service. KundPro does not claim ownership of your data.

You grant KundPro a limited license to process your data solely for the purpose of operating the Service.

7. Data Export

KundPro may provide tools that allow users to export their data.

Users are responsible for maintaining their own backups of exported data.

8. Local Data Storage

Some KundPro features may store data locally within the user's browser or device.

KundPro is not responsible for loss of locally stored data resulting from device loss, browser clearing, or other user actions.

9. Fees and Payments

Certain features of the Service may require payment.

If paid plans are offered:

  • Fees will be billed according to the selected plan
  • Subscriptions may renew automatically unless canceled
  • Fees are non-refundable unless required by law

10. Beta Services

KundPro may provide certain features as beta or experimental functionality.

Beta features:

  • May change without notice
  • May contain bugs or errors
  • Are provided without warranty

11. Disclaimer of Warranties

The Service is provided "as is" and "as available".

KundPro makes no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, KundPro shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Service.

Total liability shall not exceed the amount paid by the user for the Service during the previous twelve months.

13. Termination

KundPro may suspend or terminate accounts that violate these Terms or misuse the platform.

Users may terminate their account at any time.

14. Modifications to Terms

KundPro may update these Terms from time to time.

Updated terms will be posted on the website with a revised effective date.

Continued use of the Service constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Pennsylvania.
